Blue Ridge Rock Fest attorney shares information on refunds and insurance claims


Blue Ridge Rock Festival organizers are in the middle of an investigation done by their insurance companies.

The festival ended abruptly over the summer. Organizers said that it was due to severe weather. That created a firestorm of angry concertgoers clamoring to get their money back.

In the last few weeks organizers have completed about 25 hours of testimony concerning the festival, the preparations, and the severe weather that caused it to end early back in September.

Jonathan Wilkofsky is the attorney who’s handling the insurance claim. He said that they expect a decision about the days, however, they don’t control the time frame of that.

“The insurance company is entitled to do this investigation it’s kind of standard practice,” Wilkofsky said.” There’s a mountain of paperwork that has to be submitted, and it’s been a laborious process, but everyone has been acting in good faith. There’s been no denial of the claim and there’s been no payment to the claim.”

One thing that’s been on a lot of the concertgoers’ minds is when they will receive their refund from the 2023 festival.

ABC 13 asked Wilkofsky if the status of refunds would be determined after the claim is settled.

“As far as refunds they will have to await the position of the insurance company and the payment of the claim. We’ve been doing everything we could as quickly as we could to get that resolved. It involves forensic accountants and the size of the project, but we’re getting close,” Wilkofsky said.

Wilkofsky also shared where festival organizers stand with future plans for a 2024 festival.

“The promoters are trying to put on a ’24 show. Because of the passage of time and how long the claim has taken, doing that event at the raceway is in question. So, we’re doing our best. And obviously, as soon as plans solidify, we’ll make announcements,” Wilkofsky said.

He added the festival does not want to move forward with any plans for a 2024 festival until they’ve satisfied their commitments for 2023.

On the festival’s website, it has the tickets available for presale for the 2024 festival. Wilkofsky said that is causing some confusion. He said that the festival has not made any money from pre-sale tickets.
