Insurance company files lawsuit against Toledo Edison |


WAUSEON – An insurance company has filed a civil lawsuit against Toledo Edison Co. in Fulton County Common Pleas Court, alleging the company did not maintain external power lines which led to damages to a home.

Erie Insurance Co. filed the lawsuit Jan. 28 stating the company is the insurer of Eva and Andrew Carnahan’s residence at 520 Third St. in Wauseon. On March 7, 2023, the lawsuit alleges one of Toledo Edison’s power lines broke and was causing sparks, resulting in an electrical surge at the premises and leading to the outdoor meter and interior breaker panel being blackened and smoke in the basement of the home.

“Upon information and belief, the incident was caused by defendant’s negligent maintenance of the external power lines,” reads a portion of the filing.

Damages in the amount of $203,915.76 were paid by the insurance company in claims of real and personal property loss.

Erie Insurance is seeking compensatory and punitive damages of $203,915.76 to be determined at trial.

Toledo Edison Co. has not yet filed a response.
