Peoria man says 60 cent mistake is keeping his ‘gap insurance’ claim from being paid


PEORIA, AZ (AZFamily)- Manny Munoz bought his BMW back in 2020 and says it’s been great to drive. But more than seven months ago, someone rear-ended Manny’s car.

The damage looks minor from the photos he took, so Manny was surprised to learn that his insurance company deemed his BMW a total loss.

“That really doesn’t look that bad,” On Your Side’s Gary Harper told Manny as they looked at photos of the wrecked vehicle. Manny replied, “No, but I guess there are so many sensors on the car and cameras.”

Manny says his insurance company gave him a check for $26,709, which was the value of his BMW. But he owes around $18,651 above that.

Because Manny has “Gap” insurance through a company called Safe-Guard, it was supposed to pay that $18,000 gap. But Manny says the company hasn’t because of a small technical problem. “The claim was kicked back because the loan amount did not match the contract amount. There was a 60 cent difference.”

Here’s the problem. When Manny purchased his BMW, the dealership sent his credit union a payment request for $60,517.86.

However, the credit union sent a check for $60,517.26. It was a 60-cent mistake no one caught until now when Manny says Safe-Guard is delaying paying his “gap” because of the technical error.

According to Manny, Safe-Guard says the two amounts must match to the penny. Harper asked, “So, because that 60 cents is short, they don’t match the (gap) claim got kicked back.” Manny replied, “Yep.”

After seven months of trying to resolve the issue, Manny contacted On Your Side for help. “I was sitting there trying to contemplate what to do and so I went online, and I said let me find Gary Harper and here we are.”

On Your Side managed to get a hold of Safe-Guard and asked them to investigate Manny’s claim. After all, that 60 cent glitch is keeping Safe-Guard from paying out the $18,000 difference he owes on his totaled Beemer.

Manny says he’s glad to have On Your Side on his side because waiting seven months to close out his gap claim has been exhausting. “I don’t have a problem being patient because I think I’ve been more than patient.”

After On Your Side’s involvement, Manny’s claims seem to be progressing in the right direction. Manny says he is now getting notices from Safe-Guard indicating his claim is being “processed.” He says he hasn’t received any notices like that until On Your Side got involved.
