Court grants State Farm motion to intervene in the wrongful death lawsuit against Brooks Houck


LOUISVILLE, Ky. (WAVE) -The court has granted a motion filed by State Farm to intervene in a wrongful death lawsuit filed by the mother of Crystal Rogers.

Sherry Ballard, the mother of Crystal Rogers, the Bardstown woman who went missing over ten years ago and is presumed dead, is currently suing Brooks Houck. Houck was convicted of Rogers’ murder in July and is now serving a life sentence.

Ballard filed the lawsuit in November of 2023, after Houck was charged with Rogers’ murder but prior to his conviction. The original motion shows Ballard, as the administrator of Rogers’ estate, was seeking wrongful death damages for but not limited to “Reasonable and necessary funeral, monument and administrative expenses; Physical pain and mental suffering experienced by the decedent before her death; Lost earnings incurred by the decedent; Loss of the decedent’s enjoyment of life; and Loss of the decedent’s power and ability to earn money.”

On Dec. 4, 2025, the State Farm Fire and Casualty Company filed a motion to intervene in the suit.

In the motion, State Farm says Houck’s renter’s insurance through their company, which provides liability insurance as well, does not apply for the potential damages the lawsuit could award, as their policy only applies to accidental bodily injury or property damage and not intentional, as is alleged in the suit.

“State Farm’s policies do not provide coverage for Plaintiffs’ claims against Defendant Brooks Houck. State Farm seeks to intervene for the purpose of participating in discovery and filing a dispositive motion on State Farm’s coverage obligation,” lawyers for State Farm wrote in their motion.

The court agreed that Houck’s renters insurance only applies to accidental bodily injury or property damage and not intentional acts.
