Lawyer claims deceptive insurance practices after apartment fire leaves tenant homeless


Saraya Anderson still remembers pulling off the freeway and watching her apartment burning on Sunday. Her home was destroyed, everything inside reduced to rubble. Anderson now has no place to call home.

“You know, rebuild, get a home as soon as possible,” said Anderson.

She thought she would be able to make a claim for the losses after paying a required $15 a month for liability apartment renters insurance through the complex.

It turns out her personal contents were not covered.

“So that was kind of devastating to see,” said Anderson.

Her lawyer, Jon Powell, with Powell Law Firm says he has never seen something like this. Powell says his client was under the assumption that her items would be covered, but the policy only covered the property owner’s contents.

“So here, when you say you’re selling renters insurance but you don’t tell them it actually doesn’t cover your contents, it’s only in our favor well, that’s deceptive,” said Powell.

It’s why he believes this case ties into the Texas Deceptive Trade Practices Act, designed to protect customers from anyone selling misleading services.

“We’ve been contacted by additional apartment dwellers there who have told me the same exact story,” said Powell.

Powell says they expect to have Anderson’s lawsuit filed in 30 days.

We reached out to the property management about the issue, but they did not get back to us.

Powell says when you’re renting an apartment, be sure you read over any insurance policies and know what they cover
